Ambush Soccer Club, LLC, St. Louis Ambush, Spirit of St. Louis Dance, The Family Arena and their subsidiaries and assigns
DISCHARGE, WAIVER AND RELEASE
THIS IS A RELEASE OF LIABILITY BY THE PERSON WHO HAS SIGNED AND PRINTED THEIR NAME ON THE BOTTOM OF THIS FORM OF THEIR OWN FREE WILL (HEREINAFTER REFERRED TO AS THE “PARTICIPANT”/”PARTICIPANTS” OR IS THE GUARDIAN OF SAID PARTICIPANT(S)). SAID PARTICIPANT(S) ARE BEING PERMITTED TO PARTICIPATE IN THE ON FIELD ACTIVITIES THAT ARE PART OF THE GAME PRODUCTION OF THE ST LOUIS AMBUSH/AMBUSH SOCCER CLUB LLC, ST. LOUIS AMBUSH, SPIRIT OF ST. LOUIS DANCE, THE FAMILY ARENA AND THEIR SUBSIDIARIES AND ASSIGNS (THE "ACTIVITY"). I, AS REPRESENTING MYSELF OR REPRESENTATING ANY GROUP OF MINORS (IF APPLICABLE), AND ANY RESPECTIVE LEGAL GUARDIANS, ASSIGNS, HEIRS, AND NEXT OF KIN, AGREE AND REPRESENT THAT I UNDERSTAND THE INHERENTLY DANGEROUS NATURE OF THE ACTIVITY AND THAT THE PARTICIPANT(S) IS/ARE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I FURTHER AGREE AND REPRESENT THAT IF AT ANY TIME I BELIEVE THE ACTIVITY TO BE UNSAFE FOR THE PARTICIPANT, FOR ANY REASON, THAT THE PARTICIPANT(S) WILL IMMEDIATELY DISCONTINUE FURTHER PARTICIPATION IN THE ACTIVITY.
I AM AGREEING TO RELEASE Ambush Soccer Club LLC, St. Louis Ambush, Spirit of St. Louis Dance, The Family Arena and their subsidiaries and assigns and any of their subsidiaries FROM LIABILITY. I HAVE THEREFORE BEEN ADVISED TO READ THIS DOCUMENT CAREFULLY.
I am over the age of 18 years, or represent a minor (or minors). I FULLY UNDERSTAND THAT THE ACTIVITIES ARE INHERENTLY DANGEROUS AND INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, POTENTIAL EXPOSURE TO COVID-19 AND OTHER INFECTIONS DISEASES, WHICH COULD RESULT IN PERMANENT DISABILITY, PARALYSIS, AND EVEN DEATH (“Risks”); and these Risks and dangers may be caused by the Participant’s action or inaction, the action or inaction of others participating in the Activity, the condition of the premises in which the Activity takes place, and there may be other risks either not known to me or not readily foreseeable at this time. I recognize that the Indemnified Parties (as defined below) are not obligated to permit me to participate in or observe the Activity. In consideration of my being permitted to participate in the Activity, I HEREBY AGREE TO ASSUME SUCH HAZARDS AND RISKS and release the Indemnified Parties as set forth below.
I further agree to discharge, waive, release and covenant not to sue Ambush Soccer Club, LLC, St. Louis Ambush, Spirit of St. Louis Dance, The Family Arena and their subsidiaries and assigns and each party's respective subsidiaries, partners, members, managers, officers, directors, employees, agents and affiliates (collectively, the “Indemnified Parties”), from all claims, demands and liabilities for any and all property damage, personal injury and/or death arising from my participation in the Activity. This Discharge, Waiver and Release includes all claims, demands, and liabilities, whether known or unknown, foreseen or unforeseen, future or contingent, and includes claims, demands and liabilities arising out of the negligence of the parties so released. Furthermore, if permitted by applicable law, this release also includes claims, demands and liabilities arising out of the gross negligence or willful and wanton negligence of the parties so released. This Discharge, Waiver and Release also include claims, demands, and liabilities for indemnities and contributions arising from property damage, personal injury and/or death to a third party.
I HAVE READ THIS FORM AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY, AND I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY OF THE ACTIVITY PARTIES AND INDEMNITY PARTIES NAMED IN THE WAIVER TO THE GREATEST EXTENT ALLOWED BY LAW. I AGREE THAT IF ANY PORTION OF THIS WAIVER IS HELD INVALID, THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.
